1. The service
MakD.in is provided by MakD.in (“we”). It generates marketing creatives and captions with AI, schedules and publishes them to the social media accounts you connect, runs email, SMS and WhatsApp campaigns, builds landing pages and manages leads. Features depend on your plan.
2. Accounts
- You must be at least 18 and use the service on behalf of a business.
- Keep your password confidential; you are responsible for activity under your account.
- Each organisation has an owner who can invite team members and control their permissions.
3. Connected platforms
When you connect Facebook, Instagram, WhatsApp Business, LinkedIn, X or Google you authorise us to act on your behalf on those platforms within the permissions you grant. You must comply with each platform’s own terms and policies (including the Meta Platform Terms and the WhatsApp Business Policy). We may suspend publishing to a platform if it suspends our app or your account.
4. Your content and your customers’ data
- You keep all rights to the content you upload and to the leads and contacts you collect.
- You grant us a licence to store, process, display and transmit that content only as needed to provide the service.
- You confirm you have the right to use any logo, image, product information or contact list you add, and that you have the consents required to message your contacts.
- Messages you send through the service must not be spam. Recipients must be able to opt out, and opt-outs are enforced automatically.
5. AI-generated content
Creatives and captions are produced by AI models and may be inaccurate, inappropriate or similar to content generated for others. Review everything before it is published; you are responsible for what you approve and publish. Where your plan allows autopilot publishing without approval, you accept that responsibility for those posts too.
6. Acceptable use
You must not use the service to:
- send unsolicited bulk messages or violate telecom and anti-spam rules;
- publish unlawful, deceptive, infringing, hateful or adult content;
- impersonate others or misrepresent your business;
- probe, overload or interfere with the service or other customers’ data;
- resell the service without a white-label agreement.
7. Plans, credits and payment
- Plans are billed in advance for the period shown at checkout. Prices are shown excluding taxes unless stated.
- AI generations consume credits. Credits included in a plan reset each billing period; purchased credit packs do not expire while the account is active.
- If a payment fails we may limit the service until it is settled.
- Cancellation and refunds are described in the refund & cancellation policy.
8. Suspension and termination
You can delete your organisation at any time from Settings. We may suspend or terminate accounts that breach these terms, create legal risk or remain unpaid, after notice where practical. On termination your data is deleted as described in the privacy policy.
9. Availability and support
We aim for high availability but do not guarantee uninterrupted service, and publishing depends on third-party platforms outside our control. Support is available by email at support@makd.in.
10. Intellectual property
The service, its software, templates and branding belong to MakD.in. Content generated for you may be used by you without restriction once published, subject to the rights of any third-party material it includes.
11. Liability
To the extent permitted by law, the service is provided “as is”. We are not liable for indirect or consequential loss, lost profits, or the actions of social platforms, AI providers or messaging gateways. Our total liability for any claim is limited to the fees you paid in the twelve months before the claim.
12. Governing law
These terms are governed by the laws of India. Disputes will be handled by the courts of the place where MakD.in is registered.
13. Changes
We may update these terms. Material changes are announced by email or in the app at least 14 days before they apply. Continued use after that date means you accept the new terms.
